2. Eligibility and authority

You may use Kashif only if you have legal capacity to enter into these Terms and, where you act on behalf of a company or organization, you have authority to bind that entity. You are responsible for ensuring that your use of Kashif complies with applicable law, contract obligations, and internal authorization requirements.

3. Authorized use only

You may use Kashif only to audit websites, pages, and systems that you own, administer, or are explicitly authorized to test.

• You must not use Kashif to gain unauthorized access to any system.
• You must not use Kashif to violate security, privacy, intellectual property, or anti-circumvention laws.
• You must not submit another party’s login credentials, cookies, or protected access data unless you are lawfully authorized to do so.

4. Accounts and credentials

You are responsible for maintaining the confidentiality of your account credentials, browser extension tokens, and any access data used with Kashif. You are responsible for all activity occurring under your account unless prohibited by law.

5. Browser extension terms

If you use the Kashif browser extension, the following additional rules apply:

• The extension may capture cookies, current page URLs, and same-origin links only to create audits you explicitly request.
• You are responsible for ensuring you have authority to use your browser session and cookies for the audited environment.
• You must not modify, reverse engineer, misuse, or republish the extension in a way that violates applicable law or platform rules.

6. Audit outputs and reliance

Kashif provides automated audit findings, screenshots, scores, and reports for informational and operational use. Audit outputs are not legal advice, accessibility certification, security certification, or a guarantee of website compliance, performance, or availability. You remain responsible for reviewing findings and deciding what actions to take.

7. Third-party services

Certain Kashif features may depend on third-party infrastructure, APIs, browser engines, and hosting providers. We are not responsible for downtime, output changes, pricing changes, or failures caused by third-party providers beyond our reasonable control.

8. Fees and commercial terms

Unless otherwise agreed in writing, any commercial terms, pricing, enterprise support, service levels, or custom deliverables are governed by a separate proposal, order form, statement of work, or service agreement. Where no separate agreement exists, Kashif is provided subject to these Terms only.

9. Suspension and termination

We may suspend or terminate access to Kashif if we reasonably believe you violated these Terms, created security risk, misused the service, exposed us or others to legal risk, or interfered with the stability or lawful operation of the platform.

10. Intellectual property

Kashif, including its software, design, content, reports format, branding, and related materials, is owned by or licensed to Beitbit, except for user-provided data and third-party content. These Terms do not transfer ownership rights to you.

11. Disclaimers

To the maximum extent permitted by law, Kashif is provided on an “as is” and “as available” basis. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.

12. Limitation of liability

To the maximum extent permitted by law, Beitbit will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost business, lost data, service interruption, or reputational harm arising from or related to Kashif. Our aggregate liability for claims relating to Kashif will not exceed the amount you paid to us for the relevant service during the twelve months preceding the event giving rise to the claim, or if no fee was paid, a reasonable nominal amount permitted under applicable law.

13. Indemnity

You agree to defend, indemnify, and hold harmless Beitbit and its personnel from claims, losses, liabilities, damages, and expenses arising from your misuse of Kashif, your violation of these Terms, your unauthorized audits, or your unlawful submission of protected access data.

14. Governing law

These Terms are governed by the laws of the Sultanate of Oman, unless mandatory law in your jurisdiction requires otherwise. Any dispute arising from these Terms will be subject to the competent courts of the Sultanate of Oman, unless applicable law requires a different forum.

15. Changes to these Terms

We may update these Terms from time to time. The updated version becomes effective when posted on this page unless a later effective date is stated.
